Il s\u2019agit donc d\u2019une r\u00e9organisation des institutions jug\u00e9es d\u00e9faillantes et des lois qui en d\u00e9coulent.<\/p><p>Son principe correspond \u00e0 une r\u00e9affirmation de la volont\u00e9 populaire, aujourd\u2019hui confisqu\u00e9e. Elle s\u2019affirme par l\u2019organisation de nouvelles \u00e9lections et par la remise du pouvoir politique dans les mains du peuple souverain, ayant d\u00e9sign\u00e9 ses mandataires au suffrage universel. Ainsi, suite \u00e0 la r\u00e9union des Etats-G\u00e9n\u00e9raux en 1789, la premi\u00e8re Assembl\u00e9e Constituante fran\u00e7aise permit l\u2019adoption d\u2019une premi\u00e8re Constitution, d\u2019une D\u00e9claration des droits de l\u2019homme et du citoyen, et la fin progressive des privil\u00e8ges.<\/p><p>L\u2019\u00e9lection de la Constituante rappelle, plus particuli\u00e8rement, l\u2019exercice du droit des peuples \u00e0 disposer d\u2019eux-m\u00eames, en restaurant la d\u00e9mocratie. Elle n\u2019appartient pas \u00e0 une portion particuli\u00e8re de la soci\u00e9t\u00e9, mais veut repr\u00e9senter tous les citoyens.<\/p><p><strong>Elle vise, de fa\u00e7on universelle, \u00e0 privil\u00e9gie des candidats ind\u00e9pendants des appareils partisans et repr\u00e9sentatifs de la diversit\u00e9 sociale, et refuse le tirage au sort car il prive le peuple de son droit fondamental elementor-size-default\">Les Assembl\u00e9es constituantes dans l\u2019histoire<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7cea6eb elementor-widget data-end=\"2450\">Les assembl\u00e9es constituantes ont accompagn\u00e9 de nombreux moments fondateurs de l\u2019histoire politique : la R\u00e9volution fran\u00e7aise de 1789, la reconstruction institutionnelle apr\u00e8s des crises politiques ou encore les transitions d\u00e9mocratiques dans de nombreux pays.<\/p><p data-start=\"2457\" data-end=\"2600\">Elles permettent de red\u00e9finir collectivement les institutions lorsque celles-ci ne correspondent plus aux attentes d\u00e9mocratiques de la soci\u00e9t\u00e9.<\/p><p data-start=\"2457\" data-end=\"2600\">C&#8217;est une pratique politique normale dans un pays d\u00e9mocratique. La Constituante est par ailleurs un moyen de consolider la l\u00e9gitimit\u00e9 d&#8217;un r\u00e9gime, en le faisant mettre \u00e0 jour et valider par les
